A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the judge noted that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The legal proceedings involve disputed assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
